My mum owns a home and business out right with no mortgage. She has 3 flats which are part mortgaged. The assets were jointly owned by her and my father, he died 6 years ago. She is re marrying a man with no property or assets. On her death will he be entitled to the property, business or assets? Also, if they divorce will he have any entitilment?

I think she may need some advice from a matrimonial lawyer as to a possible pre-nuptual agreement. The assets were I assume held as joint tenants, which upon death would pass to her automatically. Any will she has made pre marriage becomes void, and so, if she ever divorced her new husband, he would have a claim potentially within matrimonial proceedings, and if she died without making a new will - he would have a claim under the intestacy rules.
