I cannot see it being a criminal matter, unless, as you say, a copy had been made, and even then, probably from the data protection aspect, rather than anything else. If they persist after an explanation that you have given, then they will have great difficulty in proving this, as you say. Furthemore, they have to show that you knew it was off limits and deliberately accessed it - i.e. not accidentally and only for the purpose of copying, rather than simply accessing it to use for the staff list - not the salaries. I think you would have to explain how you accidentally saved it to the desktop though? Realistically they would have to get evidence of the data's external use for their to have any chance of taking it further.
