I have a straightforward will in which my wife inherits everything. If she dies within 30 days my 2 sons inherit everything in equal shares (they are both fully named in the will). When one of my sons married he changed his surname by deed poll. Should I re-do my will to reflect this change of surname even though he is still obviously my son.

Thank you for your post.

It is always advisable to keep your Will uptodate with changes in your personal situation but unless you want to include new provisions in your will, a complete redraft may not be necessary. A codicil stating the name change should be sufficient.

Having said that in the case of a straighforward will the costs of preparing a codicil will be not that much less than redrafting the will and wills really should be reviewed every few years see -http://www.clicklegaladvice.co.uk/topic406-10-reasons-to-change-your-will.aspx
