Hello,

An employee had one day off sick,a telephone call was made.Then did not come in the second day but did not telephone in, even though the employer tried telephoning them and had no reply after leaving messages. This employee seems to have one or two days off work for exactly the same reason (being sick) every six weeks since January. Where does the employer stand on legal grounds regarding dismissal/warnings etc, especially if the employee does not come into work for a third day without contacting the employer.

I think you really need to have in place a written procedure for dealing with sickness absence and the procedure needs to be brought to the attention of the employees. Have you discussed the recurring problem with them when they have come back? This is a tricky area as the issue does not seem to be the sickness - but the failure to tell you what is going on - namely a conduct matter. I would suggest that after telling the person that they have to contact each morning they are going to be off, if they subsequently do not, you will, in line with your disciplinary procedure, have to take matters further.
