hi all, i hope i am putting this question, long winded as it is in the right place.
on 18th of october i attended my local county court (isle of wight) and won a judgement against PARKING CONTROL MANAGEMENT (UK) the judgement was to do with parking where i live, i live in an area overseen by a management company who had appointed the clampers to patrol our area. on the day i was clamped the manageress of the area actually told the clampers to remove the clamp as my car was parked in an area that should not be covered. the clampers refused to remove clamp without charge so i paid, and subsequently appealed which was also knocked back. the manageress refused to have anything to do with the situation and would not back me up. i took the matter to small claims court and won (PCM did not appear)
the court made judgement and informed the clampers, they have not been in touch with either me or the court. on 1st november i phoned the clampers to ask there intentions and was told their legal team would be in touch but when asked for their phone number was refused it. my question, can i seek redress from the management company for contracting PCM?

i am not going to give in to the clampers but it seems as if the court judgement is meaningless, if anyone can offer advice i would really appreciate it.....

The problem with court proceedings is that people often fail to realise is that getting a judgment, quite often is the easy part of a case, getting money paid is the hard part. If you have the address for the company and they are still trading, I would simply send the bailiffs in - which means making an application for a warrant of execution. This involves a further fee - but this can be added to the debt.

I suppose that there could be an argument against the management company as your argument would presumably be that the clamping company were acting inder the instructions and with the authority of the management company, and were therefore their agents. You would have to start fresh proceedings against the management company though.

I think the best way is to enforce against the clamping company and if you have no joy getting paid, consider an action against the management company.
