Two privately owned houses next door to each other. the first house has a 40ft tree growing against next doors wall. the roots of the tree have caused considerable damage to the neighbour's wall and driveway.
When tackled the owner of the tree agrees to have it felled but denies any liability for any other damage to his neighbour's property. Is this correct?

No, it is not correct. If the roots caused damage, then it is that person's responsibilty. It is unclear as to why the neighbour is seeking to absolve himself from responsibilty either.
