i work apart of the night shift team in a major retailer. Recently one of our workers did not show up for a shift that had been changed without his consent. He showed up for his contracted night only to be told it had been changed to the next day, he did however stay on and work that night despite the fact the rota shows he should not have been.
The rotas are done 2 weeks in advance and are set up on display and we are told to sign off our weeks. However this employee was not told of the change to his day that week and like the majority of our shift workers can only work his contracted nights due to other obligations so commonly don't check the rotas.

He is now due to be disciplined on the grounds of conduct for not showing up for a shift. My main concern for this employee is that he is still within his 12 week initial probation period and i fear the management may use this against him getting signed off for permanent employment. I will be joining him as a rep in his disciplinary and wanted to know is there any information i can take in with me that will support his side of the argument?

It seems to be a breach of contract on the retailer's part assuming he has set, hours/times worked each week and they seem to have unilaterally altered them without agreement. Was this a "one off" or a permanent change? I do not understand how the hours are posted up, yet he was not aware of them?
