Hello, thanks for the opportunity to ask questions here... I am interested in applying for a CCJ to be set aside. Very long story but I'd try and be short with it. I applied for a course online with QA ltd, and didn't complete the application process, unfortunately was inbtw Houses and when I moved in to my new place had no internet. They sent forms online to be completed within set dates which when I saw I had missed and thought since the form/mail said clearly had to be completed for the course to be taken, thought my incomplete application was cancelled; so didn't attend the course. The QA Ltd later sent my invoice after the course date, I called and explained at first they apologized and asked i disregarded invoice. However, started chasing for payments and kept sending mails to old address and even took my to court on my old address. the landlord luckily signed the court first letter and contacted me, that was when I knew they had gone to court. I responded to court's letter and provided my new address, however didn't hear anything back - only to get letters again from my previous landlord weeks later CCJ from the court saying I refused to claimant's claim. I phoned the court and asked if they saw my first reply and new address details, they lady confirmed yes but that they still sent it to my old address... Can you imagine?
Anyways, two months later the QA solicitors contacted me and asked me to please make any payment - so I agreed at that point to pay £250 just to get the matter settled; which they agreed and collected. However, in June this year I was informed by a credit reference company for this CCJ on my file... I have been very protective of my credit file and rating and would be very happy if you could advise me on my chances of getting this CCJ removed as it wasn't my fault - first the company and then the Court.
Many thanks in anticipation of your response.
J

If you have settled the matter, there is little chance of having the CCJ set aside. The only basis I can see is that of mistake in consenting to it, but there seems little prospect, unfortunately. The question which ultimately you have to answer is whether the money was owed at all, and whether you entered into a binding contract at the time.
