Hello, just need advise on course of action i need to take i'm a student working part time in a restaurant, as ive cleared some plates from a table and took them into the kitchen area ive not seen some custard that had fell on the floor so i slipped, is it my own fault that i fell or can i claim as it was the end on my shift i just went home however ive had to go the hospital today as ive straigned my wrist trying to cushion my fall this is also a problem for work now aswell as i have to take time of as my wrist is to sore to carry plates, as it is im a student and i need the part time work to be able to live and survive and work isnt going to give me sick pay because im only part time, any advice?

Hi Sam, your employer has an obligation to take reasonable care for your safety whilst you are at work. Slips and falls at work are common place and make up a huge percentage of claims brought against employers. As with any claim, its never clear cut but I would say that a lot depends on the systems that your employer has in place to deal with spillages. Do they have a cleaner to hand or (more likely) is it a "clean as you go" type thing? It would come down to the nitty gritty such as; how long the custard had been on the floor, had it been noticed by another employee who chose to walk on by? If they have a system in place which is "reasonable" then they may well have a defence. However, if they cant show that they provide training to their staff about how to deal with spillages etc and what is expected of the staff then they will find it more difficult to justify that they are doing "all that is reasonable".

Just one final point. You should report the accident to your employer so that they can complete an accident form. At least then they have it documented and they will also know why you need the time off work. I cant help with the sick pay part unfortunately but I guess you already knew that.
