I have just purchased a property with some land. Other properties situated near me have no easements for water, yet have dug up my land and instructed the water board to put meters on without my permission.

I do not want to give them an easement for water because it may affect my property and land in the longer term. However, I feel it would be unfair to deny water.

Is it possible to give a temporary water easement (ie renewable in 5 years or so)?

Should they pay me a fee for allowing pipes under my land?

Should the water board be tackled for trespass and doing work without permission nor easements?

The law relating to the supply of water is very complex and unfortunately it is not possible to give a comprehensive reply based upon the fairly scant information provided. Legislation exists to control not just the supply of water but the associated health and environmental risks as well.



It is unlikely that in the absence of express easements your neighbours would have any right to dig up your land but you should contact the Water Utility Company to clarify whether they intend to utilise any statutory powers.



You should take action promptly because if you delay your neighbours might in the future be able to argue that you have effectively agreed to the action they have taken by doing nothing and in the long term they could acquire rights as a result of your inaction.
