Hi,I was a passenger in a car acident last year.I filled out my insurance claim form and gave it to the driver of the car who passed it on to the insurers.I also went for a medical with the doctor and that was that.It was all left to the driver to sort out who hasn't mentioned a thing since.I did recieve a letter in feb 2010 from the C.R.U saying that the other party involved had checked with them to see if they needed to payback any benefits i had received due to the accident. How can i check that somebody else hasn't had this money because if they have then that to me is some sort of crime and i would like to sort this out

Hello,
It is unclear as to whether you have solicitors acting or not - I get the impression you do not as some insurers will try and deal directly with a third party such as yourself - which is certainly not in your best interests. I say this as you say " I filled out my insurance claim form and gave it to the driver of the car who passed it on to the insurers" - which is not the usual procedure if solicitors are indeed involved.
The report (after the medical examonation) would ordinarily come through to you after about 3/4 weeks after the actual examination, so I am surprised to see that nothing further is mentioned here. Certainly you would be asked to approve the report and the value of any damages would largely be based upon the content of that report.
If you have solicitors you clearly need to contact them to find out what is going on. If you are dealing directly with the insurers for the negligent driver then (and they are dragging their heels) then you need to decide whether you need someone to properly sort the matter out for you. We can do this of course and will seek to recover the costs from the third party. Certainly a CRU certificate coming through, is suggestinve of a claim that is relatively advanced (and one of these needs to be obtained before any compensation is paid by any insurer). As to payment of damages to a third party - no the insurers will not do this without some form of consent and authorisation from yourself.
